INTRODUCTIONThere are many excellent books to read, and seminars to attend, and resources available for inventors. I've found that these materials are crucial for getting a basic understanding about the invention process, and I encourage you to read as many books as you can as well as attend as many seminars as possible. Yet, even after becoming familiar with some of the basics, most people will often have questions about a specific circumstance, situation, or an unexpected problem that will come up related to their new product. CASE STUDY - David and GoliathOne example of this, is a client who started the registration process for a trademark. But after his trademark was issued about a year later, another company filed a "cancellation" action with the U.S. Trademark Office, claiming that his new trademark was infringing on their company's existing trademark. My client was in a "David and Goliath" situation. The company was the third largest in its field. The "cancellation" action was a full legal lawsuit, that he was required by law to participate in, meaning he couldn't just drop it and walk away from it. His attorney in a large law firm, was processing the routine paperwork for this lawsuit, and estimated that it would cost him at least $30,000.00 in attorney fees to fight it. To begin with, he didn't have that kind of money to fight the case. But he was told that even if he went forward, he wasn't guaranteed that he would win the lawsuit. One day, his attorney, who was female, gave him a one-day notice to let him know that she would be gone on pregnancy leave, and that another attorney would be taking over his case! So his prospects seemed pretty bleak - he would either lose his investment to date in the trademark registration if he dropped the use of his trademark, or he could fight it with a very large cost and still risk losing the lawsuit and the use of his trademark. This was the situation when I stepped in to consult with my client. After a lot of research, brainstorming, and recommendations, the result was that a settlement agreement was reached directly with the large corporation, then both side's attorneys put it into an agreement. He was allowed to continue using his trademark on a more limited basis, which he was very happy with. Plus, his costs ended up being less than a third of the projected costs to fight the case. It ended up a win-win situation for everyone. Please note that I didn't replace his attorney, because they were essential in drafting the settlement agreement as well as handling all the required legal paperwork throughout the process.
